Phase system

In the Netherlands job agency are obligated to work with a phase system for you labour contract.

There are two systems based on wich CAO (NBBU or ABU) a job agency is following, names are different but besides that there is almost no difference between the two systems.

BAM Works is registered at CAO NBBU and therefore is following the 1 till 4 phase system. Beneath you will find the standard procedure, sometimes we can decide to give you faster a contract in the next phase.


Phase 1-2: In this phase we can give an unlimited amount of contracts. A contract should be for at least 4 weeks. The termination time of the contract is 1 day for both employer as employee. The contracts in these phase have an ‘employment clausule’ this means that the contract is ending when our client wants to stop the cooperation for whatever reason.

After 26 weeks the notice period for the clients becomes 10 days.

After 52 worked weeks you continue to the next phase (phase 3). When in between there is a break off 6 months between two working weeks then the counting of working weeks start again from 0.

Phase 3: In this phase we can give a maximum of 6 contracts and it can take maximum 3 years. The notice period is statutory and is depending on how long you worked for us. There is no ‘employment clausule’ anymore in these contracts. When there is a break inbetween working from more then 6 months you start again in phase 1-2.

Phase 4: You receive a contract for an undetermined period. So only 1 contract with no end date. The notice period is also statutory and depening on how long you are already working for us.
